Notice is hereby pursuant to the provisions of Chapter 40A, Section 5 of the Massachusetts General Laws that the Lenox Planning Board will hold a public hearing for a proposed amendment to the Lenox Zoning Bylaw entitled the “Short-Term Rental of Private Homes”. The hearing will take place on Tuesday, April 17th, at Lenox Town Hall, 6 Walker Street, Lenox at 6:00 PM. Draft copies of the proposed “Short-Term Rental of Private Homes” Bylaw are available at the office of the Lenox Town Clerk during regular business office hours, between 8:30 a.m. and 4:00 p.m. Monday through Friday and on the Town of Lenox website 24/7: www.townoflenox.com.

    • Chestnut Lane: Continued discussion regarding Chestnut Lane; vote on and if approved, sign certificate of performance; get update on recommended name and number of street address and vote if necessary.In June 2016, the Planning Board endorsed a Form A for property on Chestnut Lane held by the Macalin Realty Trust. This endorsement was with a covenant for the restoration of the road. They have since restored the road, and require a certificate of performance from the Planning Board. In December, the Planning Board had a site visit inspect the road to ensure it has been constructed in accordance with the covenant. At tonight’s meeting, they will vote to and if agreed, sign the certificate of performance. Materials related to this project are on file with the Town Clerk at Town Hall, 6 Walker St., Lenox, and can be reviewed during scheduled business hours.

The Applicant seeks to develop nine (9) single family homes on 9.5 acres under Sections 3.4 and 9.7 of the Lenox Zoning Bylaw: “Special Permits” and “Open Space Flexible Development”. The Application and supporting materials are available for review at the office of Town Clerk in Lenox Town Hall between the hours of 8:30 AM and 4:00 PM and on the Town website 24/7.

The Special Permit Granting Authority for this is the Planning Board. They would like to attend the August 22nd Planning Board meeting to informally present their conceptual plan, as suggested in some of the guidance documents.

Meeting of the Short Term Rentals subcommittee, whose goals include exploring the issue of non-owner occupied Short Term Rentals, the rental period currently allowed for all Short Term Rentals, and other related issues. (“Short Term Rentals” (STRs) is the term for transient tourist rentals less than 30 days typically booked via such sites as AirBnB, VRBO, HomeAway, FlipKey, etc.)

  1. Minutes — Approve minutes for June 29 meeting
  2. Citizens’ Open Forum — Note, citizens also may ask to comment after a particular agenda item, with the approval of the chair, time permitting
  3. Stockbridge participation — Explain participation of Stockbridge Planning Board/citizen members.
  4. “Enforcement” including of non-owner occupied rentals and other compliance issues — Clarify that role of this subcommittee and of Planning Board does not include enforcement. Update on feedback from Town Hall on this issue.
  5. 2014 Town Attorney memo — Review and discuss opinion letter from Town Attorney memo from 2014
  6. Building Commissioner meeting update — Update on July 6 meeting with Building Commissioner B.J. Church to learn what Massachusetts building code requirements are required for non-owner occupied Short Term Rentals.

The Lenox Planning Board will hold a PUBLIC HEARING Pursuant to Massachusetts General Law Chapter 40A, Section 5 on Tuesday, April 25th at 6:00 p.m. in Lenox Town Hall to share proposed amendments to the Lenox Zoning Bylaw for the regulation of medicinal marijuana facilities and a moratorium for recreational marijuana facilities for consideration at Annual Town Meeting on May 4, 2017.
